Questa normativa descrive le informazioni che trattiamo per poter fornire agli utenti i servizi presenti in Green App.

I. Quali tipi di informazioni raccogliamo?

Raccogliamo – al momento dell’iscrizione – le seguenti informazioni, classificabili come dati personali ai sensi della normativa europea vigente:

  •                  nome e cognome dell’utente;
  •                  indirizzo email.
  •                  

Le modalità di raccolta possono avvenire attraverso il conferimento dei dati diretto da parte dell’utente.

Raccogliamo inoltre informazioni provenienti da cellulari e/o tablet su cui l’utente utilizza l’applicazione al fine di consentire il funzionamento del servizio e per l’utilizzazione di alcune funzioni del device.

Le informazioni che raccogliamo da questi dispositivi – non classificabili come dati personali – comprendono:

  •                  identificatori: identificatori univoci del dispositivo (tag id);
  •                  impostazioni del dispositivo: informazioni che riceviamo tramite le impostazioni del dispositivo attivate dall’utente, come l’accesso a posizione GPS, fotocamera o foto;
  •                  rete e connessioni: informazioni quali nome dell’operatore mobile o ISP, lingua, fuso orario, numero di cellulare, indirizzo IP, velocità di connessione e, in alcuni casi, informazioni su altri dispositivi nelle vicinanze o nella tua rete.

II. Come usiamo queste informazioni?

Usiamo le informazioni in nostro possesso nelle modalità descritte qui sotto per fornire e supportare Green App. Ecco come:

a. utilizziamo la geolocalizzazione dell’utente per aiutarlo nella selezione del Comune, o della frazione, nella quale desidera avere informazioni in ordine alle modalità della raccolta differenziata.

b. utilizziamo il tag id del dispositivo mobile per inviare notifiche agli utenti in merito alla raccolta differenziata e/o rispondere le segnalazioni sui prodotti;

c. utilizziamo la geolocalizzazione e l’area selezionata dall’utente per consentirgli di ricevere, attraverso l’app, informazioni puntuali sulla raccolta e sulle modalità di conferimento dei rifiuti;

III. Queste informazioni vengono condivise?

I dati forniti ed il loro utilizzo vengono trattati unicamente da Baron S.r.l. e dalla Municipalità di appartenenza.

I dati, in forma aggregata ed anonima, vengono utilizzati unicamente per finalità statistiche sull’utilizzo dell’applicazione da parte degli utenti e condivise con i comuni abbonati.

Relativamente ai Comuni in cui è attivo il servizio di segnalazione di degrado, Baron condivide i dati con l’amministrazione che provvede a gestire il problema e segnalare la sua risoluzione direttamente tramite email all’utente.

Possiamo condividere informazioni con forze dell’ordine o in risposta a richieste legali quando sia disposto dalla legge o ordinato da un magistrato attraverso un provvedimento specifico con valenza legale e obbligatoria nei confronti di Baron S.r.l.

Qualora l’utente abbia accettato di ricevere informazioni pubblicitarie profilate, possiamo condividere i suoi dati con Google.

IV. Quali sono le nostre basi legali per il trattamento dei dati?

Le basi legali del trattamento sono rappresentate da:

– svolgimento del servizio ai sensi dell’art. 6 GDPR – in relazione ai dati trattati per consentire il corretto utilizzo di Green App e delle funzioni presenti nell’App;

– consenso ai sensi dell’art. 6 GDPR – in relazione ai dati degli interessati forniti a Google per consentire l’invio di informazioni pubblicitarie profilate.

Raccogliamo, usiamo e condividiamo i dati in nostro possesso nelle modalità descritte in precedenza:

  •                  secondo necessità per rispettare le Condizioni d’uso di Baron S.r.l. e dell’App Green App;
  •                  in modo coerente con il consenso concesso, che può essere revocato in qualsiasi momento attraverso l’invio di una richiesta al Titolare del Trattamento dei dati tramite mail all’indirizzo info@baron.it;
  •                  secondo necessità per rispettare i nostri obblighi di legge;
  •                  secondo necessità per il pubblico interesse.

V. Quali sono i diritti degli utenti?

Le norme europee vigenti in materia di privacy (General Data Protection Regulation) ti riconoscono i seguenti diritti rispetto ai tuoi dati:

1. diritto di accesso: l’utente ha il diritto di ottenere informazioni in ordine al tipo di trattamento concretamente effettuato dei tuoi dati; ad eventuali soggetti terzi ai quali sono stati comunicati e alle modalità di conservazione degli stessi. Può inoltre chiedere una copia per la quale sarà tenuto a dover rimborsare eventuali costi sostenuti per l’adempimento.

2. diritto di rettifica: l’utente ha il diritto di chiedere ed ottenere la rettifica dei dati qualora siano stati trascritti o riportati in maniera non accurata o non completa.

3. diritto alla cancellazione dei dati: l’utente ha il diritto di richiedere ed ottenere la cancellazione dei dati personali che ha fornito. Green App potrebbe non essere accessibile in tale ipotesi

4. diritto alla limitazione al trattamento dei dati: l’utente ha il diritto di richiedere ed ottenere la limitazione parziale e/o cancellazione parziale dei dati. Green App potrebbe non essere accessibile in tale ipotesi

5. diritto alla portabilità: l’utente ha il diritto di ricevere i dati personali in un formato comunemente utilizzato per la trasmissione automatizzata al fine di poterli inviare ad un altro soggetto senza previa comunicazione a Baron.

6. Diritto di opposizione al trattamento: l’utente ha il diritto di opporsi in ogni momento al trattamento dei dati personali e richiederne la cessazione. Qualora il trattamento non sia più necessario o l’opposizione sia fondata, Baron darà riscontro positivo alla richiesta. Ti ricordiamo che tale diritto non sussiste nel caso l’utente abbia fornito i dati per concludere un accordo o per eseguire le prestazioni derivanti da un accordo già in essere con Baron.

7. L’utente ha il diritto di revocare in maniera parziale e/o totale il consenso precedentemente prestato all’utilizzo all’App. In tal caso Green App potrebbe non funzionare correttamente.

VI. Come esercitare il diritto all’oblio, alla cancellazione parziale e la libera portabilità del dato?

Gli utenti possono chiedere la cancellazione, totale o parziale, dei propri dati personali in ogni momento direttamente al titolare del trattamento dei dati.

E’ possibile richiedere la cancellazione inviando un’email all’indirizzo info@baron.it nei seguenti casi:

  •                  qualora venga revocato il consenso all’utilizzo;
  •                  qualora i dati non siano più necessari per gli scopi rispetto ai quali sono stati raccolti;
  •                  qualora l’utente si opponga legittimamente al trattamento.

Pervenuta la richiesta, Baron si impegna a dare corso a tale richiesta tempestivamente, entro 36 ore, nei limiti di quanto tecnicamente possibile.

Il diritto all’oblio potrà essere limitato solo nei seguenti casi:

  •            & nbsp;     per garantire l’esercizio della libertà di espressione o il diritto alla difesa in sede giudiziaria;
  •                  per tutelare un interesse generale;
  •                  quando i dati, resi anonimi, siano necessari per ricerche storiche o per finalità statistiche o scientifiche.

Gli utenti possono inoltre richiedere, sempre tramite mail all’indirizzo info@baron.it, il trasferimento dei propri dati personali e di utilizzo ad un altro soggetto titolare dei dati che svolga il medesimo servizio di Green App.

VII. Come e per quanto tempo sono conservati i dati degli utenti?

I dati degli utenti sono conservati su server Amazon e risiedono in ??? ed in ????(indicare i Paesi dove sono questi Server).

Le caratteristiche e le certificazioni delle macchine utilizzate garantiscono la massima sicurezza degli stessi e minimizzano i rischi di violazione e di “data breach.”

I dati non vengono comunicati, trattati o inviati al di fuori del territorio dell’Unione Europea.

Qualora l’account venga eliminato, procederemo all’immediata cancellazione di tutti i dati personali degli utenti. Potremo mantenere unicamente informazioni – in via anonima – su abitudini di utilizzo a fini puramente statistici e di miglioramento del servizio offerto.

In ipotesi di perdita, sottrazione o distruzione dei dati degli interessati, Baron provvederà a comunicare, entro e non oltre 36 ore dal “breach”, l’evento in accordo con la propria policy interna, a redigere un processo verbale e ad inviarlo immediatamente alle autorità competenti.

VIII. Come adempiamo alle richieste legali o evitiamo danni?

Accediamo, conserviamo e condividiamo informazioni con enti regolatori, forze dell’ordine o altri soggetti in questi casi:

  •                  in risposta a una richiesta legale qualora riteniamo in buona fede che la legge ci imponga di farlo.
  •                  qualora sia necessario per rilevare, prevenire e risolvere usi non autorizzati dei prodotti, violazioni delle nostre condizioni o normative o altre attività dannose o illegali, per proteggere noi stessi (compresi i nostri diritti, proprietà o prodotti), anche nell’ambito di indagini o richieste normative o per prevenire morti o lesioni fisiche imminenti.

IX. Come informeremo l’utente in caso di modifiche alla presente normativa?

Baron provvederà ad informare gli utenti in ordine al rilascio di una nuova versione dell’informativa tramite comunicazione in-app o via mail.
